Leaving a rented home before the lease expires does not automatically end a tenant’s financial obligations in Dubai. An early departure generally requires an applicable contractual exit clause, a written agreement with the landlord or a recognised legal basis.

Tenants who move out without resolving the tenancy could remain liable for rent or compensation, according to legal specialists quoted by Gulf News.

When can tenants end a lease early?

Salam Pappinissery, CEO of Yab Legal Services, said Dubai Law No. 26 of 2007 treats a valid lease as binding during its agreed term.

He outlined three possible routes to an early exit:

Mutual agreement: The landlord and tenant agree in writing to end the tenancy.
Contractual exit clause: The agreement permits early termination, subject to its notice requirements, penalties and procedures.
Recognised legal grounds: Circumstances may justify formal action, such as a property being condemned through a technical report attested by Dubai Municipality.

Where a landlord seriously breaches their obligations, including leaving a property uninhabitable, a tenant may seek remedies through the Rental Disputes Centre (RDC). Such claims require documentation and formal proceedings.

Can the landlord refuse?

Dr Sunil Ambalavelil, Global Executive Chairman at Kaden Boriss, said Article 7 prevents either party from ordinarily ending a valid fixed-term tenancy unilaterally.

Relocation for work, personal circumstances or finding another home does not, by itself, create an automatic right to leave early, he explained.

If no applicable exit clause or legal ground exists, the tenant generally needs to negotiate. The landlord may refuse, leaving the existing contract binding.

Does 90 days’ notice allow an early exit?

Giving 90 days’ notice does not automatically release a tenant from a lease.

Ambalavelil explained that Article 14 concerns proposed changes to tenancy terms upon renewal, unless otherwise agreed. It does not establish a general early-termination right.

Some contracts separately allow an early exit with 90 days’ written notice and compensation equivalent to two months’ rent. Whether that option applies depends on the clause’s wording and compliance with its conditions.

What penalties may apply?

Pappinissery said there is no single statutory early-termination penalty. Costs depend on the contract, a negotiated settlement or an RDC determination.

Possible outcomes include:

An applicable exit clause: Its notice period and compensation provisions apply. Penalties commonly amount to one or two months’ rent.
A negotiated departure: Both parties agree on compensation, notice, outstanding payments and any refunds.
No clause or agreement: The tenant may remain liable for rent or compensation for the landlord’s losses.
Departure without notice or agreement: The landlord may pursue unpaid rent, damages and RDC proceedings, while prepaid rent may also be at risk.

Steps to take before moving out

Ambalavelil recommended checking the tenancy agreement first, including how notice must be delivered and what payments are required.

If the landlord agrees to an early departure, the written settlement should specify:

The termination date.
Outstanding rent and any compensation.
Treatment of the security deposit.
Property inspection and handover arrangements.

Tenants should document the property’s condition, settle utility and service charges, retain proof of notice delivery, and obtain written confirmation of termination and handover.

If negotiations fail, tenants can seek guidance from the Dubai Land Department or refer the dispute to the RDC, as appropriate.
