UAE: How to Resign During Probation: Understanding the Labour Law

In the UAE, employees have the right to resign during their probation period, provided they adhere to specific regulations outlined in the Labour Law.

According to Federal Decree-Law No. 33 of 2021, the probation period is designed to benefit both employers and employees, allowing for performance assessments and workplace acclimatization.
Employees wishing to resign must notify their employer at least one month in advance if they plan to transfer to another company.
Alternatively, they can pay compensation equivalent to their salary for the notice period. If leaving the UAE entirely, a 14-day notice is required, or employees must compensate for the notice period as well. Failing to comply may lead to a one-year labour ban.
Certain categories are exempt from this labour ban, including those with family-sponsored residency visas, individuals applying for a new work permit with the same employer, and skilled professionals whose qualifications are in demand.
This guidance ensures that employees are informed of their rights and obligations while navigating their employment transitions in the UAE.
