UAE Jobs: Can Employers Shorten the 6-Month Probation Period?

In the UAE, the standard probation period for employees is set at six months, as defined by Federal Decree Law No. 33 of 2021 on Employment Relations.
This period allows employers to evaluate an employee’s performance and helps employees acclimate to their roles.

Employers can indeed implement a probation period of up to six months, but this duration must be clearly stated in the employment contract.
If an employee wishes to resign during this period to join another employer, they are required to provide one month’s notice. Additionally, the new employer must compensate the current employer for any recruitment costs incurred.
Employees who terminate their contracts without adhering to these regulations may be liable to pay compensation equivalent to the notice period.
If an employee intends to negotiate a shorter probation period, this must be mutually agreed upon and reflected in the contract.
